Taylor C. Hartley,

Mr. Hartley, senior attorney of The Advocate Attorney, L.L.C., and associates Mr. H.D. Gailey and Mr. Travis Blackburn provide effective representation for those accused of crime.

Mr. Hartley

Having worked with four former prosecutors and a judge, Mr. Hartley finds purpose and meaning in his work defending people accused of crime.  With a psychology degree and juris doctor, he understands many of the complexities surrounding criminal behavior and the difficulties of false accusations.

He has worked on a small number of cases as a public defender for Lehi City and Utah County and currently works as private defense counsel, obtaining favorable outcomes for his clients.  

These include outcomes of not guilty (acquittal), plea in abeyance, significantly reduced charges, and dismissal.  

ACQUITTAL: For example, after trial on a domestic violence case, Mr. Hartley was able to have his client acquitted of all charges.

PLEA IN ABEYANCE DISMISSAL: In another of his cases, Mr. Hartley was able to persuade a court to help encourage, rather than discourage or merely punish, a person charged with felony drug possession to have a second chance by giving her an ultimate dismissal through a plea in abeyance agreement.

DISMISSAL: In another example, Mr. Hartley's client was charged with second degree felony attempted murder.  Mr. Hartley was able to get the matter entirely dismissed by successfully showing it was a case of misidentification. 

Other successes include working with law enforcement and claimed victims to prevent the unnecessary filing of criminal accusations of the most severe kind and negotiationg effective resolutions that benefit everyone involved.

Mr. Hartley has been working in law firms since 2002 and focusing on criminal defense since 2006 when he moved with his wife from California to Utah.  He earned his Jurist Doctor degree in 2005 while studying in San Diego, being trained in arguably the most difficult State for legal issues.

Mr. Hartley is a member of the Utah Association of Criminal Defense Lawyers (www.uacdl.org), the largest group of criminal defense attorneys in Utah. 

Like The Advocate Attorney, UACDL is dedicated to promoting and protecting justice by supporting the defense of the Constitution and the rights of individuals.

For over a year, from 2007 to 2008, he had the privilege of clerking for a Fourth District Court judge as his law clerk and bailiff, which provided Mr. Hartley with exceptional legal experiences daily, both in court, observing litigation, and out of court, writing opinions for the judge on civil and criminal matters.  

The judicial clerkship gives Mr. Hartley unique and valuable insights into the judicial process.  He can better strategize the best outcomes as a result of the many judicial experiences.

n 2008, while working for the courts, he also taught Criminal Justice classes at Provo College, including Criminology--the study of crime and why people commit it.  In 2011, he taught a paralegal course at Weber State University. 

Mr. Hartley is a published author, as of June 2011, whose book explains in detail the answer to "Why defend the guilty" from both a legal and religious perspective.

In short, Mr. Hartley thrives on serving his community in the public and private sectors as well as in academia.  He sincerely believes in the virtues of criminal defense and the power it has to genuinely help those who are especially in need of legal protection.

H.D. Gailey, Esq. 

 Mr. Gailey

Mr. H.D. Gailey, who speaks fluent Spanish, earned a bachelors degree in communication from the University of Utah, and a juris doctorate from the University of Idaho in 2006. 

Mr. Gailey spent the first years after graduating from law school representing large corporate entities in civil litigation.  After a few years, Mr. Gailey found more satisfaction obtaining favorable outcomes for his clients accused of criminal injustices.  He enjoys protecting the constitutional rights of all people.

Mr. Gailey gained valuable criminal experience while interning with the Moscow City Attorney’s Office, as well as the with the ADR Administrator & Staff Attorney U.S. District Court for the District of Utah and as a CASA volunteer for the Couer d’Alene Indian Tribe where he worked primarily with domestic violence and child abuse matters.

He has taught paralegal courses to college level students looking to enter the legal field.  In addition, has given numerous seminars to college and high school students regarding business ethics.

Mr. Gailey is resourceful and willing to put in the hours to get the job done, often resulting in creative solutions to difficult issues.  Mr. Gailey is a fun loving individual with a calming demeanor.  And while he takes each individual’s situation seriously, he has the ability to bring laughter to the most stressful situations.

Travis Blackburn, Esq. 

Mr. Blackburn is the newest associate at The Advocate Attorney, working out of the Price area, Utah.  He has tremendous experience in a variety of areas of the law, including bankruptcy, wills & estates, family, personal injury, and criminal law.

As an attorney, Mr. Blackburn has worked for the Tanner Law Office (2010 – 2012) in Huntington, Utah, at Ascione, Heideman & McKay, a partnership with 11-50 employees (2008 – August 2010), and as a judicial clerk at the Fourth District Court (2007–2008).  Mr. Blackburn received a Juris Doctor at Columbia School of Law in the University of Missouri.
